Claims made against by taxpayers by HM Revenue & Customs increase year on year. Dealing with tax disputes requires a solicitor with specialist tax litigation experience: somebody who as a matter of routine deals with all aspects of tax related disputes, whether in the Tax Tribunals, County Court or High Court.
Where is the decision of HM Revenue & Customs is disputed it will often require the taxpayer to take the matter up, either with an independent HMRC officer or lodge an appeal with the First Tier Tax Tribunal. Tax Tribunal Rules govern these procedures that are quite different to the rules that non-specialist solicitors are familiar with.
There may be circumstances in which there is no alternative remedy available to the taxpayer other than to apply to the High Court in Judicial Review: once again these are specialist proceedings that require familiarity with procedures and the outcome sought.
